Family Legacy Films — Purchase Terms
The Elephant Room LTD Co · Greenville, South Carolina · Last updated October 21, 2026
These Purchase Terms apply when you buy a Family Legacy Film from The Elephant Room LTD Co, a South Carolina limited liability company located in Greenville, South Carolina ("Elephant Room," "we," "us"). "You" means the person who pays (the "Purchaser"). The person being filmed is the "Subject." By completing payment you agree to these terms.
1. Packages
Sit-Down Film — $497. One recording session at one location (about 2 hours on site; the interview itself usually runs 60–90 minutes). Photos you supply are woven into the film. Finished film: up to about 20 minutes, depending on the footage.
Legacy Film — $1,250. One extended recording session (about 4 hours on site). Archival photos and documents you supply, plus recreated moments or illustrative visuals where they help the story. Finished film: up to about 45 minutes, depending on the footage.
Film lengths are estimates, not guarantees. The final length depends on the Subject's stories, their energy and comfort on the day, and what the footage supports in editing.
Add-ons (quoted in writing before you agree to them): USB keepsake copy, full unedited interview file, interviews with additional family members, photo scanning.
2. Service Area and Travel
Prices include travel within about 60 miles of Greenville, South Carolina. Recording farther away (including the Charlotte and Atlanta areas) carries a travel fee that we quote in writing before the recording is scheduled. You are never charged a travel fee you did not agree to in advance. If you decline the quoted travel fee, you may cancel for a full refund.
3. Booking and Scheduling
After payment we will contact you within 2 business days to set up a short planning call and the recording date. You may reschedule the recording once at no charge with at least 48 hours' notice. We may reschedule if the Subject is unwell, for severe weather, or for an emergency, and we will offer the next available dates.
4. Gift Purchases
A gift purchase is issued as a Gift Voucher for one named package (for example, "One Sit-Down Family Legacy Film"). The voucher is for that service, not a cash amount.
The front of every Gift Voucher states, in capital letters of at least 10-point type: "REDEEM BY BOOKING A RECORDING DATE ON OR BEFORE [date one year after purchase]."
After that date, nothing is lost. If the voucher was not used, the amount paid stays available as a credit toward any Elephant Room service for five (5) years from the purchase date. There are no dormancy, inactivity, or service fees of any kind, and the voucher's value never goes down over time.
5. Family Chip-In
Family members may contribute toward one film through our Family Chip-In link. The person who organizes the chip-in is the Purchaser under these terms. We schedule the film once contributions reach the package price. If contributions have not reached the package price within 90 days, the organizer may choose to (a) top up the balance, (b) apply the total to a smaller package with any difference refunded, or (c) have every contribution refunded in full. If a chip-in film is refunded under Section 7, refunds go back to each contributor's original payment method in proportion to what each paid.
6. If the Subject Cannot Be Recorded
Health can change. If the Subject becomes unable to be recorded, or passes away before recording, you may choose any one of the following:
Transfer the booking to another family member at no charge;
Convert it to a Tribute Film built from photos, home videos, and interviews with family members, at the same package price;
Keep it as credit under Section 4; or
Refund under Section 7. If the Subject has passed away, the booking fee is waived and the refund is in full.
We do not record anyone who cannot understand and agree to being recorded unless a person with legal authority signs for them and the Subject does not object. When there is doubt, we recommend option 2.
7. Cancellations and Refunds
Within 14 days of purchase, if no recording has taken place: full refund.
After 14 days and before the recording date: refund minus a $100 booking fee (waived as stated in Section 6, and never charged on a cancellation caused by our rescheduling).
After recording has taken place: no refund, because the work has begun, except as stated in Sections 8 and 11.
Refunds are issued to the original payment method within 10 business days of the request.
8. Delivery and Review
Most films are delivered within about 45 days of the recording date. Actual timing depends on the footage, the editing the story needs, and when we receive any photos or materials you are supplying. Films recorded January through March may take up to about 60 days because of holiday-season demand. We give you a target date at booking and keep you updated if it moves.
If, for reasons within our control, we have not delivered your film within 120 days after the recording date, you may request a full refund.
You receive one review round. Within 14 days of delivery you may send one consolidated list of changes, such as trimming or removing a segment, swapping or adding supplied photos, or correcting names, dates, or spellings. We make those changes and deliver the final film. Further rounds, re-recording, or changes in package scope are quoted in writing before any work begins.
The film is delivered as a private online viewing link and a downloadable file. We keep the viewing link active for at least 12 months; please download and keep your own copies.
9. Materials You Provide
You confirm that you have the right to give us the photos, recordings, and documents you supply, and permission for them to be used in the film. Please send copies or scans, not irreplaceable originals. If originals must be handed to us, we handle them with care and return them in person or by tracked mail. Our responsibility for loss or damage to an original is limited to the replacement value of the physical item, except where the loss is caused by our gross negligence or willful misconduct.
10. Ownership and Use
Elephant Room owns the copyright in the film and grants you and the Subject's family a permanent, royalty-free license to keep, watch, copy, and share it for personal, non-commercial purposes. We will not sell, license, or publicly release the film. We use short excerpts as samples of our work only if the Subject (or their authorized representative) opts in on the Subject Consent and Appearance Release, and we honor any written request to exclude specific segments.
11. Our Responsibility
We back up recordings during production. If footage is lost or damaged before delivery through our fault, we will offer a re-recording at no charge or a full refund, at your choice. Except where the law does not allow it, and except for gross negligence or willful misconduct, our total responsibility for any claim relating to a film is limited to the amount you paid for it.
12. General
These terms are governed by South Carolina law. Any dispute will be heard in the courts located in Greenville County, South Carolina, and either of us may use magistrate's (small claims) court for claims within its limit. Nothing in these terms limits any right you have under South Carolina consumer-protection law that cannot be waived. If any part of these terms is unenforceable, the rest remains in effect. These terms, your order confirmation, and the Subject Consent and Appearance Release are the full agreement about your film.
